Artykuł uzupełnia zagadnienie charakteru prawnego świadectwa energetycznego o
aspekt jego znaczenia w procesie karnym. Nawiązując do poprzednich artykułów podkreślono
The article complements the discussion on the legal nature of the energy performance certificate by addressing its significance within criminal proceedings. Referring to previous articles, it emphasizes that in light of the provisions of the Criminal Code, the preparation and signing of a false energy performance certificate by an authorized person constitutes the authentication of an untruth regarding legally significant circumstances. Consequently, such a person faces potential criminal liability for unprofessional or unlawful practice of a profession. The conclusions note the absence of appropriate legal regulations that turns the energy certification system into a new, largely unnecessary public-law obligation. In this sense, these documents are far of promoting EU policy regarding the energy efficiency of buildings.
